TERMS AND CONDITIONS
Our highest priority is to ensure customer satisfaction, but we understand a refund may be the only resolution of some circumstances. Our promise is to do everything in our power to ensure that you are completely satisfied with the product(s) you purchase from Blue Mountain Precision.
However, no refund will be issued until we have had an opportunity to examine and test the product in our shop to ascertain malfunctions or tolerance issues. We do not warranty our products for: wear and tear; damage caused by improper or inadequate use; physical damage (including, but not limited to scratches, corrosion, use of aggressive cleaning agents, etc.). All Blue Mountain Precision warranties are voided by work on a product or firearm by a gunsmith other than Blue Mountain Precision or any alteration to the product or firearm.
General Products (items manufactured by others, other than optics, triggers and suppressors):
General products can be returned for exchange, if in new, unused condition. General products must be returned with postage/shipping paid by the customer and we will ship the correct product back to the customer. Optics are non-returnable, unless for a manufacturer’s defect. If a manufacturer’s defect is detected in an optic, the customer must contact Blue Mountain Precision and we will coordinate with the manufacturer to replace the optic. Suppressors are non-returnable. Triggers are non-returnable, but warrantied by the manufacturer. If a manufacturer’s defect is detected, the customer must contact Blue Mountain Precision and we will coordinate with the trigger manufacturer to replace or repair the trigger.
Custom Products:
All rifles, barreled actions, pre-fit barrels, ammunition and associated labor are not refundable or returnable. However, our promise to do everything in our power to ensure that you are completely satisfied with any custom product order from Blue Mountain Precision. Custom ammunition may only be used in the specific firearm for which the order was made. We will mark the serial number of the rifle on the custom ammunition packaging. Any use of custom ammunition in a rifle or firearm other than that identified by the specific serial number voids all warranties and acts to release Blue Mountain Precision from any and all liability associated with or arising from the product, sale and use of said ammunition.
Disclaimer of Warranties and Limitation of Liability
This site is provided by Blue Mountain Precision, LLC, DBA Blue Mountain Precision, on an as is and as available basis. Blue Mountain Precision disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Blue Mountain Precision does not warrant that this site, its servers, or email sent from bluemountainprecision.com are free of viruses or other harmful components. Blue Mountain Precision will not be liable for any damages of any kind arising from the use of this site or products purchased from this site, including, but not limited to, direct, indirect, incidental, punitive and consequential damages.
General Shipping Policy
All firearms (complete rifles or barreled actions) must be delivered to an authorized Federal Firearms Licensee within the state of residence of the customer for authorized transfer of the firearm. Customers are responsible to provide Blue Mountain Precision with necessary contact and shipping information.
All firearms are shipped via insured United Parcel Service (UPS). Customers are responsible for all shipping and insurance charges.
All non-custom, in-stock products are shipped within 2-3 business days after payment is received. All special orders (including, but not limited to, optics, barrels and triggers) are shipped as soon as available from the manufacturer.
All custom orders (including, but not limited to, custom rifles, barreled actions, pre-fit barrels and custom ammunition) are shipped upon completion.
Risk of Loss
All items purchased from bluemountainprecision.com are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to the customer upon or deliver to the carrier.
Electronic Communication
When a customer visits bluemountainprecision.com or sends emails to us, the customer is communicating with us electronically and the customer consents to receive communications from us electronically. We may communicate with the customer by email. The customer agrees that all agreements, notices, disclosures and other communications that we provide to the customer electronically satisfies any legal requirement that such communications be in writing.
Product Descriptions
Blue Mountain Precision attempts to be as accurate as possible. However, Blue Mountain Precision does not warrant that product descriptions or other content of this site is accurate, reliable, current, or error-free. If a product offered by Blue Mountain Precision is not as described, the customer’s sole remedy is to return it in unused condition.
Applicable Law
By visiting or ordering from Blue Mountain Precision or bluemountainprecision.com, the customer agrees that the laws of the State of Utah, without regard to principles of conflict of laws, will govern these Terms and Conditions and any dispute of any sort that might arise between the customer and Blue Mountain Precision, LLC, DBA Blue Mountain Precision and bluemountainprecision.com.
Disputes
Any dispute relating in any way to your visit to bluemountainprecision.com or from doing business with Blue Mountain Precision, LLC, DBA Blue Mountain Precision, shall be submitted to confidential arbitration in the State of Utah. Arbitration under these Terms and Conditions shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms and Conditions shall be joined to an arbitration involving any other party subject to these Terms and Conditions, whether through class arbitration proceedings or otherwise.
Site Policies, Modification and Severability
These policies govern your visit to bluemountainprecision.com. We reserve the right to make changes to our site, policies, and these Terms and Conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
